Chiefs boss’s divorce set for a showdown

A Kaizer Chiefs executive’s plan to be a free agent will be decided in the court chambers after their spouse filed papers in the Joburg High Court to challenge the official’s decision to blow the final whistle on their marriage.

Sunday World can exclusively reveal that the partner of the popular executive has filed the papers in court to oppose the application for a decree of divorce.

The spouse, who was red-carded by the official last month, has instructed law firm Biccari Bollo Mariano Incorporated to defend the application.

“Pleased to take notice that the defendant hereby gives notice of her intention to defend the above-mentioned action.

“Be pleased to take notice further that the defendant hereby appoints the offices of Messrs Biccari Bollo Mariano Inc, 8a Bradford Road, Bedfordview 2007, as the address for service of all documents, pleadings and notices in the above-mentioned matter,” read the papers she filed in court last week.

The top executive, who is one of Kaizer Chiefs chairman Kaizer Motaung’s children,
has kicked their spouse to the kerb, citing irreconcilable
differences.

The disintegration of the official’s union became known after the top executive, who cannot be named for legal reasons, applied for a decree of divorce.

According to the documents Sunday World has seen, the club’s top executive, who is the applicant in the divorce matter, claims that their marriage has broken down and cannot be saved, and they now seek the annulment of the union.

They stated they and their partner, who also cannot be named for legal reasons, were married out of the community of property with accrual.

“The marriage relationship between the parties has irretrievably broken down and has reached such a stage of disintegration that there is no reasonable prospect for its restoration,” read the court papers.


The executive also cited ambitions, goals and life pursuits that have grown in divergent directions as among the reasons for their faltered connubiality.

The club mandarin has also applied for a court order for the equitable calculation and distribution of the accruals of their respective estates.

The official also said that their spouse, who still lives under the same roof as the official, should financially contribute towards the maintenance of their matrimonial pad.

Their equal contribution towards their offspring will pay for food, medical aid, clothes, school fees, uniforms, extracurricular activities, school transport, birthday gifts and entertainment, they stated.

The Amakhosi executive has challenged their spouse to indicate within 10 days whether or not they wish to oppose the application for the decree of divorce and division of the estate.

The executive said if their spouse disputes the claim and wishes to defend the action, she must, within 10 days after receiving the summons file with the registrar of the court, give notice of their intention to defend.

Thereafter, said the executive, their spouse should, within 20 days after filing and service of the notice of intention to the defendant, file with the registrar and serve upon the official a plea, exception, or notice to strike out, with or without a counter-claim.

The executive also warned their spouse that they could face judgment without further notice if they failed to file and serve notice.

  1. The journo had painstakingly tried to his the sex or identity of the executive bit he fumbled with this extract from the court paper:

    “The executive said if their spouse disputes the claim and wishes to defend the action, SHE must, within 10 days after receiving the summons file with the registrar of the court, give notice of their intention to defend”.

    I suspect the executive is Kaizer Motaung Jnr.
