Johannesburg – The Education Labour Relations Council (ELRC) has taken the decission to reinstate Malcolm Williams to his former post as Principal of Parktown Boys’ High School in Johannesburg.
The Gauteng Department of Education has voiced its disappointment regarding the decision.
The department fired Williams in December last year, nine months after the death of Grade 8 pupil Enock Mpianzi, who drowned at the Nyati Bush and Riverbreak Lodge in the North West.
In its Arbitration Award between the Gauteng Department of Education (GOE) and Williams, the ELRC ordered that Williams be re-instated to his post on the same terms and conditions as before his December 2020 dismissal.
He is expected to return to his official duties on 1 July 2021.

The Council further ordered that Williams be remunerated for the six months that he had not been working.
The GOE in December 2020 dismissed Williams for his role in the events that led to the unfortunate death of a Grade 8 learner, Enoch Mpianzi at a botched school outing which was not sanctioned by the Department.
A subsequent investigation into the death of the learner by Harris, Nupen and Molebatsi (HNM) Attorneys led to Williams being charged on three counts of misconduct – two of which were upheld following the disciplinary proceedings.
The two charges were for allowing the trip to take place without the GDE’s approval; while the second one related to Williams’ failure to ensure that a correct roll call was taken on the day of the incident. The last charge, related to Williams’ culpability in the death of Mpianzi.

While disappointed with the outcome of the ELRC processes, the GOE has indicated that its studying the decision and seeking legal counsel on the matter.
“We are not fully happy about the outcome of the case but also realise that this matter has been dragging for too long; negatively affecting all who are affected. In that light, we will look for advice from the experts with a view to finding a last resolution to the matter,” MEC Lesufi said.
