Gospel sensation Xolisa Kwinana’s ex-lover has dragged him to court after accusing him of being a deadbeat dad.
The woman, who cannot be named to protect the identity of the children, filed a maintenance suit against the award-winning musician at Khayelitsha Magistrate’s Court in Cape Town last month.
According to the woman, Kwinana failed to pay maintenance for the two children he sired with her.
According to court papers seen by Sunday World filed on August 8, the woman is demanding a total of R7 000 in child maintenance from the popular music megastar for their two children, all below the age of three years.
The papers state that the woman wants R4 000 for their three-month-old tyke and R3 000 for their 18-month-old infant.
News that the popular musician had been dodging maintenance for his children reached the antenna of our sources after Khayelitsha court maintenance officers emailed a police boss in Eastern Cape requesting him to serve Kwinana with a subpoena when he arrived for a performance at a show in Gqeberha last Sunday.
The court officials had been tipped off by anti-gender-based-violence activist Nosipho Daniels of Malihambe Women Outreach Non-Profit Organisation that the artist would be strutting his stuff at the music festival.
The correspondence to the police read “Good day General. Please find the attached subpoena for Xolisa Kwinana, who will be in Port Elizabeth [at the} Boardwalk on Sunday.
“Please serve on behalf of our court, and in return, please furnish the court with the signed copy of the subpoena. We have received your details from V Daniels.
“Your co-operation in this regard will be highly appreciated,” reads the email authored by maintenance officer Anele Zwelonke.
However, it appears the police did not cooperate with the court officials because they failed to serve the artist with the paperwork at the show.
A source close to both the woman and the musician alleged that Kwinana has not paid child maintenance towards the upbringing of the two children since breaking up with their mother.
The two broke up after she accused him of physically and financially abusing her.
“When they broke up, she was pregnant with his child. She left and went to stay at a shelter. When she gave birth to the child about three months ago, he came to see the child, but has not contributed money to support the children.
“She then went to court to report him for failing to maintain the children. The court officials issued a subpoena for him to appear in court on October 1, but they did not know his address; hence, they asked the police to serve him during the show in Port Elizabeth.
“But the police did not do that when we asked them. They told us that they did not receive the subpoena,” said the deep throat.
The police wrote a text message to Daniels on Wednesday saying that they got hold of Kwinana on the phone and promised to serve the subpoena on him.
“Xolisa also mentioned that he was already communicating with a Zuko or Luzuko from Khayelitsha court, where he was committed to attend the court proceedings (sic). He has proof of their WhatsApp communication. I have asked him to sign the return of service once he returns tomorrow,” read the text message. Kwinana said he was shocked that his wife filed a child support case against him.
“That scares me because I’m supporting my children and will prove that in court,” he said.
