Ncwana goes to court to get back her R500 000

Beauty queen Rosette Ncwana’s acrimonious fallout with skin clinic Ananda Aesthetics took an ugly turn after the model dragged the company and its directors to court over non-payment of the half million loan she granted them.

In the court papers that she filed with the Johannesburg High Court, Ncwana stated that she entered into an investment and loan agreement with the trio on October 12 last year.

According to Ncwana, the terms and conditions of the loan stipulated that she would electronically transfer the money into the entity’s nominated account.

In exchange for the loan, the directors would transfer the shares of Ananda Aesthetics to her upon receipt of the funds within a period of three days.

Owner of the shares

They agreed that Ncwana would be the owner of the shares of the company until the entity repaid the loan to her.

“On or about October 13, 2023, the plaintiff made payment as per the agreement into the bank account nominated by the first defendant (Ananda Aesthetics) in the sum of R500 000.00 (five hundred thousand rand),” read the papers.

Ncwana said the company only refunded her R20 000 and failed to repay her the R480 000 outstanding balance, thus breaching their agreement.

After failing to refund her, Ncwana approached her lawyers, Bhana Attorneys, who wrote a letter of demand to the trio on April 29 to remit payment.

On the same day, she stated in the papers, the directors replied to the letter through their legal representatives, saying that they would revert to her in due course.

“As a result of the breach committed by the defendants, the plaintiff has suffered damages, as alluded to.

“In the premises, the first and second defendants are indebted to the plaintiff in the sum of R480 000.00 (four hundred and eighty thousand rand), which sum is due and payable to the plaintiff,” read the papers.

Loan agreement

Ncwana said she terminated the loan agreement as a result of the breach of the agreement and demanded the full repayment of her loan.

She complained that the company directors and the entity had enriched themselves at her expense because they refused to pay back her money.

“The plaintiff has suffered damages in the form of money loaned and advanced in accordance with the agreement without the defendants complying with the said agreement.

“The plaintiff has suffered damages in the sum of R480 000.00 (four hundred and eighty thousand rand), which sums were loaned and advanced to the defendants and which the defendants have failed to repay on demand,” read the papers
