‘Senzo murder accused told Kelly Khumalo they were on their way’

The lawyer of one of the men accused of murdering former Bafana captain Senzo Meyiwa told the court that his then girlfriend Kelly Khumalo called the suspects to find out their whereabouts.

Defence counsel advocate Thulani Mngomezulu who is representing accused number one, Muzi Sibiya, in the case, cross-examined Vodacom’s Forensic Liaison Supervisor, Pinky Vythilingam, about cellphone numbers belonging to singer Kelly Khumalo, who was Meyiwa’s lover.

Mngomezulu told the court that there’s a Section 205 procedure pertaining to cellphone records for accused number three, Mthobisi Mncube, concerning Kelly Khumalo’s numbers.

Explosive confession

“According to the state, accused number two made a confession and in that confession it states that accused number three was in communication with Kelly Khumalo. Do you follow me?

“In terms of that confession, Kelly Khumalo called accused number three and asked him where were they and the answer was sisi we are on our way. That’s what is in that confession,” said Mngomezulu.

He added that there was evidence that was presented in court stating that Khumalo was using six different cellphone numbers.

He said this as the Pretoria High Court saw an effective resumption of the Meyiwa murder trial following a four-week break. However, it was not clear whether the call Mngomezulu was making reference to happened on the day in which Meyiwa was murdered.

This comes as Vythilingam, wrapped up her testimony led by state prosecutor advocate Ronnie Sibanda on Monday.

Claims of six cellphone numbers

“What you did give is evidence related to two cellphone numbers that belong to Kelly Khumalo but you would agree with me, I understand that Kelly Khumalo was using six cellphone numbers according to evidence that is yet to be confirmed, this is not according to your evidence,” said Mngomezulu.

However, Sibanda objected.

“I will object at this stage because I do not recall the confession statement stating on which number was that communication coming from or how many cellphones was accused number three or anyone carrying on that particular day, so it is unfair for Mngomezulu to ask this witness to compare such information with exhibit GGG2,” said Sibanda.

Presiding judge Ratha Mokgoatlheng said Mngomezulu is insinuating that the confession is the truth.

Before the court went on recess in June, defence counsel for accused number three, advocate Charles Mnisi said Longwe Twala (who was in the house on the day of the incident) and Kelly Khumalo have not been to court to confirm that the numbers belong to them.

“Without those witnesses coming to testify and confirm that these are their numbers, the evidence that relates to those numbers will be on record on a provisional basis,” said Mnisi.

Meyiwa was shot in October 2014 at the Vosloorus home of his then girlfriend Kelly Khumalo, where the Bafana Bafana and Orlando Pirates star was visiting with friends.

The trial continues.
