The protracted legal battle between radio icon Pabi Moloi and her disputed estranged husband, Ruan Adams, has taken a nasty turn when he demanded paternity tests, claiming that television presenter Christopher Jafta cuckolded him and could have possibly sired the child with her.
Adams made the startling allegations in an application he filed in the Johannesburg High Court, where he seeks an order to force Moloi to undergo the DNA tests to prove that he is the father of their child.
“I have suspected for some time that (name withheld) is the biological child of a television personality and former colleague of the respondent, namely Christopher Jafta.
“The respondent had a love affair with Christopher Jafta around the same time that the respondent and I were together sexually,” Adams stated in the court papers Sunday World has seen.
Adams said that he entered into a shotgun union with a pregnant Moloi after she insisted that she did not want the child to be born out of wedlock.
He further said Moloi, a former YFM presenter, did not want him to be present when she was breaking the waters and cutting the child’s umbilical cord.
“She did not want me present at the birth of (name withheld) and refused to register me as (name withheld)’s father and then denied the existence of the marriage.
“The respondent has subsequently tried all means possible to limit the contact that I have with (name withheld), which at present is under the supervision of a social worker.
“The respondent’s conduct has created doubts as to whether I am (name withheld)’s father, and I must obtain clarity in order to put those doubts to rest.
“If I am confirmed to be the father of (name withheld), I will seek an order thereafter to amend the birth certificate to reflect me as (name withheld)’s biological father,” he said.
Adams said the problem started between him and the Power FM radio talk show host when he filed for divorce on May 4, 2022, in which he claimed, inter alia, a decree of divorce and comprehensive relief pertaining to his parental rights and responsibilities in respect of the child.
However, he stated, Moloi has, in her plea and counterclaim, denied the existence of the customary matrimony between them.
“I am not registered as (name withheld)’s father on his birth certificate, and the respondent has refused to register me as such. I am advised, which advice I accept, that in terms of the Children’s Act, a person who claims paternity may apply to a court with the appropriate jurisdiction for an order confirming his paternity if, inter alia, the mother of a child refuses to amend the birth certificate to reflect the applicant as the biological father on the birth certificate.
“I am further advised, which advice I accept, that section 37 of the Children’s Act 38 of 2005 states that in circumstances where a respondent refuses to consent to a paternity test, a court can warn the mother that such refusal might affect her credibility.
“The respondent has not responded to this request,” he stated.
Adams said Moloi rushed him into their failed nuptials and then left him almost straight away. When he filed for divorce, Moloi denied that they were betrothed and refused to give him half of the residual of her lucrative estate, which includes several properties worth millions of rands in Joburg.
“My attorney has advised me, and which advice I accept, that there is a rebuttable presumption in law that when a child is born within wedlock, the husband of the woman who gave birth to the child is presumed to be the biological father of the child. In this instance, the respondent has denied the existence of the marriage, and thus the rebuttable presumption does not apply to these proceedings,” he stated.
