Former Generations actress and now gender activist Rosie Motene has applied for default judgment against Podcast and Chill with MacG crew for failing to file papers to defend the lawsuit she filed against them in the Joburg High Court a few months ago.
This after MacGyver “MacG” Mukwevho, Thandubuntu “Sol” Phenduka and Duduzile Methula failed to file a motion of notice to defend the defamation lawsuit in which she is demanding an apology and R200 000 from the trio.
MacG is defendant number two while Phenduka and Methula are defendants three and four respectively in the matter.
Motene has excluded comedian Mongenzi “Tol A$$ Mo” Mahlangu, who is defendant number one, from the application because he has filed a motion of notice to defend the suit.
In the papers which she filed in the Joburg High Court on October 3, Motene said MacG, Phenduka and Methula, failed to enter into an appearance after summons was served on them by the sheriff of the court.
“The summons was served on the second defendant on August 14 2023, the summons was served on the third defendant on 16 August 2023, the summons was served on the fourth defendant on 14 August 2023.
“The dies indiciae (ten days) expired on 28 August 2023 for the second and fourth defendants and 30 August 2023 for the third defendant.
“The second, third and fourth defendants have not entered an appearance,” read the papers.
Unlike the three podcasters, Mahlangu has through his lawyers Minnie & Du Preeze Incorporated, filed a notice of intention to defend.
“Be pleased to take note that the 1st defendant hereby enters his intention to defend the above action,” read the papers.
In the lawsuit papers, which we have seen, Motene said during or about 2021, Mahlangu was charged with rape and sexual assault of popular catwalk queen Lerato Moloi.
She said she was not subpoenaed to court to give evidence at Mahlangu’s trial, who was acquitted in 2022.
Mahlangu, she said, was later interviewed on December 8, 2022, on the popular podcast.
She said during the interview, Mahlangu called her “Koo beans” and “Satan’s child”.
This because, Motene said, Mahlangu claimed she had pressured the National Prosecuting Authority (NPA) to prosecute him for the alleged rape.
“The biggest b*tch to attack me. Biggest number one feminist f@&cking b***h, Rosie Motene … Ask any nigga will tell you. Koo beans!
“Ngwana Satan [Satan’s child],” Mahlangu said. Motene said Mahlangu went on to accuse her of exerting pressure on the NPA to prosecute him.
“She [Rosie Motene] was busy coaching Lerato.
“Tell them he raped you. Tell them! Tell them, tell them you want your day in court.
“Akenya pressure ko NPA [she put pressure on the NPA],” he said.
Mahlangu said the NPA did not succumb to Motene’s pressure and refused to prosecute him.
Motene said Mahlangu’s words “Koo beans” and “ngwana Satan” were derogatory, wrongful, defamatory and injurious to her dignity as were intended and understood by the public to mean that she had unlawfully colluded with NPA and maliciously attacked him.
“As a result of the defamation, the plaintiff has been damaged in her reputation and dignity and has suffered damages in the sum of R200 000.
“Wherefore the plaintiff prays for judgment against the defendants, jointly and severally, the one paying, the others to be absolved,” read the papers.
Motene is also asking the court to issue an injunction to order Mahlangu to post a video and apologise to her on social media and on the podcast.
She wants MacG, Phenduka and Methula, to also apologise for caricaturing her.
The apology, she said, has to read as follows: “We hereby apologise for broadcasting the defamatory statements made by Mr Mahlangu regarding Rosie Motene on 8 December 2022, on the Podcast and Chill with MacG podcast”.
