ATM mounts legal challenge over IEC conduct during elections

Vuyolwethu Zungula, the African Transformation Movement (ATM) president, has filed papers with the Electoral Court to ensure that electoral integrity and justice are met.

This comes after allegations of misconduct were levelled against the chairperson of the Independent Electoral Commission (IEC).


In a statement on Wednesday, the ATM said the party incorporated the compelling allegations put forth by advocate Winston Erasmus, a former ANC researcher in the Western Cape legislature, in an affidavit sworn on May 9.

IEC allegedly conspired with ANC

“We outlined how the IEC chairperson allegedly conspired with the ruling party to undermine ATM’s participation in the democratic process, including attempts to deregister the party and manipulate election outcomes,” reads the statement. 

The party further stated that it has instructed its legal team to initiate legal proceedings to challenge the fairness of the May 29 general elections.

“In our filings, we address significant concerns regarding the credibility and impartiality of the IEC in overseeing elections.

“The documented irregularities and inconsistencies observed during the elections strongly suggest that the IEC has veered away from its mandate, becoming embroiled in irregularities and inconsistencies and compromising its ability to administer fair elections.

“It is evident that the IEC’s actions have led to suspicions of voter fraud and vote rigging, undermining the very foundation of democracy.

“The ATM emphasises the necessity for a revote, presenting compelling reasons why such action is warranted in pursuit of electoral justice and accountability.”

Upholding the principles of democracy

The party added that, due to the developments, it is not party to a request made by the forum of opposition parties to the Chief Justice, Raymond Zondo, to facilitate coalition talks among political parties.

“The ATM remains committed to upholding the principles of democracy and ensuring that the voices of all South Africans are heard and respected.

“We hope that the Electoral Court will swiftly and diligently give these allegations due consideration,” said the ATM.
