Suspended police sergeant Fannie Nkosi is facing additional charges of defeating and obstructing the course of justice following a new investigation by the commission’s recommendations investigative task team.
Police national spokesperson Brigadier Athlenda Mathe said in a media statement Nkosi is expected to appear before the Thohoyandou Magistrate’s Court in Limpopo on Friday while he is already in custody for other charges.
Mathe said the criminal charges relate to an incident dating back to November 10, 2022, when a suspect was arrested for possession of dagga, unlicensed firearms and explosives.
According to Mathe, investigations revealed that sergeant Nkosi fetched the original case docket under the pretext that he had been sent by Head Office.
“A few months later, he allegedly returned to Thohoyandou, identified himself as a Colonel from Head Office, and removed the confiscated dagga from police custody,” she said.
Mathe added that Nkosi later booked in the exhibit at the head office, but investigators subsequently discovered that one of the exhibit bags containing the dagga was tampered with.
“A case of defeating and obstructing the course of justice has been registered for investigation,” said Mathe.
The latest charges add to Nkosi’s mounting legal troubles, which escalated after his testimony before the Madlanga Commission of Inquiry. Nkosi became one of the commission’s most controversial witnesses after being questioned over alleged links to underworld figures, leaks of confidential police information and interference in criminal investigations.
Following his testimony, police raided his home, where investigators reportedly found cash, state dockets and ammunition. Nkosi was arrested on April 3 and faces charges including unlawful possession of a stun grenade, contravening the Firearms Control Act, unlawful possession of ammunition, unlawful possession of SAPS property, and possession of police dockets.
He has remained behind bars while facing several charges linked to investigations stemming from the commission’s findings.
