ANC charges former president Jacob Zuma over MK Party

The ANC has finally charged former president Jacob Zuma for his involvement with the uMkhonto weSizwe (MK) party, according to a notice of set–down document issued by the ANC’s National Disciplinary Committee.

Dated April 24, 2024, the notice outlines two counts against Zuma.

The first count accuses Zuma of contravening the ANC Constitution. It alleges that he acted in collaboration with a political organisation other than one in alliance with the ANC.


The document cites Zuma’s address to the MK party in Soweto on December 16, 2023, where he purportedly called for the dislodging of the ANC as the ruling party.

The second count alleges Zuma’s violation of Rule 25.17.13 of the ANC Constitution by joining or supporting a political organisation contrary to the aims and policies of the ANC.

This charge stems from Zuma’s appearance on the list for public representatives of the MK, a party not in alliance with the ANC.

Contravening rules of the ANC Constitution

“That you are guilty of contravening Rule 25.17.13 of the ANC Constitution. It reads: Joining or supporting a political organisation or party, other than an organisation in alliance with the ANC, in a manner contrary to the aims, objectives and policy of the ANC.”

“That you are guilty of contravening Rule 25.17.17.4 of the ANC Constitution, which reads, acting on behalf of or in collaboration with a political organisation or party other than an organisation or party in alliance with the ANC in a manner contrary to the aims, policies and objectives of the ANC.”

Zuma is vying for the presidency in the upcoming elections under the MK party banner. He  holds dual membership in both the ANC and the MK.


IEC vs Zuma saga

However, his candidacy sparked controversy when the Independent Electoral Commission (IEC) initially disqualified him under Section 47 of the constitution. The constitution bars candidates convicted for more than 12 months from contesting elections.

Although the electoral court overturned the IEC ruling, the matter escalated to the High Court. It recently ruled that Section 47 does not apply to Zuma due to the unique circumstances of his conviction.

The IEC has sedulously pledged to appeal this decision. The hearing is scheduled for May 10, 2024, just 19 days before the elections.
